Under Alabama Code Section 30-3-175, the Department of Human Resources (DHR) can suspend your driver's license when child support arrears equal or exceed six months of your court-ordered obligation. DHR doesn't need a separate court order to do this — the administrative suspension authority is built into the child support enforcement statute.

The suspension notice comes from DHR, not from ALEA or a court. Many drivers don't realize the hold exists until they're pulled over, try to renew their license, or run a background check for employment. By that point, the arrears have often grown substantially.

Steps to Clear the Hold

Step 1: Contact your local county DHR Child Support Enforcement Office. This is the agency that initiates the release. ALEA cannot lift the hold without an administrative clearance from DHR.

Step 2: Negotiate a payment plan. If you can pay the full arrears, ask DHR to process the release. If a court order does not define repayment terms, DHR guidelines require a lump-sum payment plus an agreement to pay at least 25% of your current monthly support obligation toward the arrears each month. The specific terms depend on your county office and your total balance.

Step 3: Execute the payment agreement. Once you and DHR agree to terms and you make the initial payment, DHR transmits an administrative release to ALEA. This transmission typically processes within 2 to 3 business days.

Step 4: Pay the ALEA reinstatement fee. After DHR's release reaches ALEA, you'll owe a $50 child support reinstatement fee to ALEA. This fee is separate from anything you owe DHR and is specific to child-support-related suspensions.

Step 5: Verify your abstract is clear. Pull a fresh Driver Abstract from ALEA ($5.75) to confirm the hold has been removed. If it still shows, visit an ALEA Reinstatement Office with your DHR payment receipts — processing delays between agencies are common.

What If You Can't Afford the Arrears

If your financial situation has changed since the original support order — job loss, disability, reduced hours — you may be able to request a modification of your child support obligation through the court. A modification doesn't erase the existing arrears, but it can lower your ongoing obligation and make the DHR payment plan more manageable.

DHR may have payment terms available for your circumstances. If you're facing genuine hardship, explain your situation to the enforcement officer and ask what terms apply. Losing your license can make it harder to earn the income needed to pay support, so raise that practical problem directly.

An Affidavit of Substantial Hardship may be relevant to related court filings, but the $50 ALEA reinstatement fee is a separate charge; ask ALEA whether any waiver applies to your case.

Timelines You Should Know

Once the payment plan is executed, DHR's administrative release is typically processed by ALEA within 2–3 business days. Payment-plan negotiations and other active holds add time.

Other Holds May Be Stacked

A child support hold is rarely the only issue on an Alabama driver's abstract.
