Under Section 20-2A-34, any patient whose physician certifies a daily dosage exceeding 75 mg of delta-9-tetrahydrocannabinol (THC) faces automatic driver's license suspension.

This isn't a DUI-related suspension. It's a purely administrative action triggered by the dosage on your medical cannabis certification — regardless of whether you're impaired while driving, regardless of whether you drive at all. The suspension is automatic once the state licensing system flags the dosage threshold.

How the Threshold Works

The 75 mg daily THC limit applies to the dosage your physician certifies under Alabama's medical cannabis program. If your physician determines that your condition requires more than 75 mg of delta-9 THC per day and documents that on your certification, the state can suspend your license based on the certification alone.

This creates a tension for patients with conditions that genuinely require higher doses — chronic pain, certain neurological conditions, or treatment-resistant symptoms. You and your physician need to weigh the driving privilege impact when determining dosage levels.

A few important clarifications:

• The limit is delta-9 THC specifically, not total cannabinoid content. Do not rely on a product label or another cannabinoid measurement without confirming how the medical-cannabis program and ALEA apply the rule.
• It's based on the certified dosage, not on what you actually consume on a given day. If your certification says 80 mg/day, the suspension trigger applies even on days you take less.
• Holding a valid medical cannabis card alone doesn't trigger suspension. Only certifications above the 75 mg THC daily threshold do.

What to Do If Your License Is Suspended

If your license has been suspended under this provision, you have a few options:

Ask about correcting the certification. If you believe your medical needs can be met at or below 75 mg daily THC, ask your physician and the Alabama medical-cannabis program what correction, if any, can be made to the certification. Then ask ALEA what documentation it requires for a reinstatement request.

If you believe the suspension was applied in error, contact ALEA's Driver License Division to ask what review or correction procedure applies and what documents it requires. Keep your certification documents and any supporting correspondence from your physician.

Reinstatement after the hold is cleared. Do not assume that a reduced certification or discontinuation automatically clears the suspension. After ALEA confirms that the underlying hold is cleared, follow its standard reinstatement process and pay the applicable fee.

Driving Under the Influence Still Applies Separately

Even with a valid medical cannabis card and a dosage under 75 mg, you can still be charged with DUI if you're impaired while driving. Alabama's DUI statute (Section 32-5A-191) applies to any substance that impairs driving ability, and medical cannabis authorization is not a defense to impaired driving.
