Delaware Clean Slate Act: Automatic Expungement Status and What It Means for Your Record

What the Clean Slate Act Does

The Delaware Clean Slate Act — passed in November 2021 through Senate Bills 111 and 112 — expanded who qualifies for mandatory expungement and authorized the State Bureau of Identification (SBI) to run monthly automated sweeps of eligible records. The goal: clear qualifying criminal records from public-facing background check databases without anyone needing to file paperwork.

Records eligible for automatic clearance include non-conviction cases (dismissals, acquittals, nolle prosequi entries) with no waiting period when there are no pending charges, single-violation convictions after three years, and eligible misdemeanors after five years. The conviction-based categories require no prior or subsequent convictions on the record.

The Rollout Delays

The automated system was supposed to launch on August 1, 2024. It did launch, but not the way anyone expected.

The Delaware Criminal Justice Information System (DELJIS) initially identified roughly 290,000 adults with nearly 600,000 eligible cases. But the SBI found records in the DELJIS export that didn't actually meet statutory criteria — cases with unmapped out-of-state convictions, unresolved companion charges, and other data discrepancies. To avoid clearing records that shouldn't be cleared, the SBI shifted from automated processing to manual, case-by-case review.

That bottleneck was severe. By December 31, 2025, only 26,601 records had been cleared — a pace that would have taken over twenty years to work through the backlog.

The June 2026 Breakthrough

On June 1, 2026, Governor Matt Meyer announced that the state had completed its first fully automated batch clearance, processing more than 64,000 eligible records in a single sweep. That one batch cleared more than three times the total volume of cases processed during all of 2025.

The automated system now handles data integration between DELJIS, the SBI, and the state court systems without requiring individual manual review. The state has targeted clearing the remaining backlog — over one million cases — through continued automated sweeps.

Why You Might Still Be Waiting

Two problems remain even after the June 2026 milestone:

No individual notification. Delaware doesn't send you a letter or email when your record is cleared through Clean Slate. The only way to know is to check yourself — either through the court access portal or by paying $72 for a new certified SBI criminal history check via IdentoGO.

Backlog scale. Over one million cases still need processing. Even with automated sweeps running monthly, predicting when any individual record will be reached is impossible. If you have a job offer contingent on a clean background check or a housing application waiting on results, the automated queue may not move fast enough.

How to Bypass the Wait

Under 11 Del. C. § 4373A(d), you're legally permitted to file a manual petition even if your record qualifies for automatic clearance. Filing manually puts your case on a tracked, individual timeline rather than waiting for the next batch sweep.

For mandatory-eligible records, the manual process works through the SBI directly: pull your certified criminal history ($72), receive the SBI determination letter (about two weeks), sign and return the mandatory application packet within 30 days with a $75 money order. The SBI processes these individually — no court appearance needed.
