Does Michigan Expungement Clear Federal Records?
A Michigan set-aside makes your conviction non-public at the state level but does not physically destroy the underlying record. The research confirms that federal immigration and firearm consequences are separate from the state set-aside process; it does not establish whether or when an FBI record is updated.
How State and Federal Records Differ
Michigan's set-aside process changes the state record from public to nonpublic. The conviction remains in the restricted file, available to the entities and for the purposes listed in MCL 780.623. In a petition case, MSP forwards a complete set of fingerprints to the FBI for comparison with records available to that agency (MCL 780.621d(8)); that process does not establish whether or when an FBI disposition record is updated.
What Happens After a Set-Aside
When a Michigan court grants a set-aside, the clerk sends the order to the arresting agency and MSP, which updates the state record. Do not assume that this state update changes a separate federal record.
Updating the NICS Record
If a person remains prohibited under MCL 750.224f(2) for a specified felony, MCL 28.424 provides a circuit-court restoration process after five years have passed from completion of all fines, imprisonment, and probation or parole conditions; the applicant must show by clear and convincing evidence that they are not likely to act in a manner dangerous to public safety. For a federal NICS record that causes an erroneous denial or extended delay, the FBI's Voluntary Appeal File can help prevent repeat delays or erroneous denials. A VAF entry does not itself establish firearm eligibility or guarantee a proceed result.

Federal Employment and Security Clearances
Federal employment and security-clearance forms have their own disclosure instructions. A Michigan set-aside does not physically destroy the underlying record; follow the specific form's directions and seek legal advice if a question is unclear.
Immigration Proceedings
For non-citizens, a Michigan set-aside does not necessarily eliminate immigration consequences. Federal immigration law often continues to treat a conviction set aside for rehabilitation as a conviction, while a vacatur based on a legal defect may be treated differently. The effect depends on the offense and case history, so get immigration advice before filing or answering immigration questions.
Non-citizens should keep copies of relevant court records and consult an immigration attorney before filing, because the federal effect depends on the case and a state set-aside does not resolve every immigration question.
