The Court Bill
The criminal court imposes two categories of financial penalties at sentencing:
The fine: Up to $2,000 for a Class 1 misdemeanor under SDCL 32-23-2. Most first-offense sentences land between $500 and $1,000 unless aggravating factors push the judge higher.
Standard court costs: $96.50, broken down as $50.00 court automation fee, $41.50 in liquidated costs, and a $5.00 victim's compensation surcharge. These are fixed — every first-offense DUI defendant pays the same amount regardless of the fine.
Chemical analysis fees: If you consented to a blood or breath test, the state charges you for the lab work — $85.00 for an alcohol-only analysis or $145.00 if drugs were also tested. If law enforcement obtained a warrant for a blood draw, the fee jumps to $165.00 (alcohol) or $225.00 (alcohol and drugs).
Total court-imposed costs for a typical first offense: $680 to $1,400 before you factor in anything else.
License Reinstatement Costs
After your revocation period ends (minimum 30 days for a standard conviction, one year for a chemical test refusal), getting your license back requires:
- Reinstatement fee: $50.00 paid to the Department of Public Safety
- Duplicate license fee: $28.00 for the new physical card
- Class 1 re-issue fee: $8.00 if applicable
You also need to schedule an in-person appointment at a DPS exam station and bring two physical documents proving your South Dakota residential address (utility bills, rental agreements — digital copies rejected).
SR-22 Insurance
SR-22 is a certificate of financial responsibility that your auto insurance carrier files electronically with DPS. You don't file it yourself — only the insurer can submit it.
The costs stack up over three years:
- SR-22 filing fee: $15 to $25 one-time setup from your carrier
- Monthly insurance premium increase: $21 to $26 per month above your normal rate, for three continuous years
- Total three-year SR-22 cost: Roughly $771 to $961 including the filing fee
The three-year clock is strict. If your SR-22 policy lapses for any reason — missed payment, carrier cancellation, switching insurers without transferring the SR-22 — DPS instantly suspends your license and the three-year period resets to zero. You'd pay another reinstatement fee and start the full three years over.

Treatment and Monitoring Programs
These costs depend on your BAC level and what the court orders:
Chemical dependency evaluation: $150 to $275, mandatory if your BAC was 0.17% or higher, commonly ordered for everyone. The evaluation determines your treatment recommendations.
12-hour DUI education class: $175, often required as a probation condition.
24/7 Sobriety Program (if ordered):
- Enrollment fee: $30 to $40
- Twice-daily PBT testing: $2.00 per day ($60/month)
- SCRAM ankle bracelet (alternative to twice-daily reporting): $40 activation + $6.00/day ($180/month) + $40 deactivation
- Drug patches (if applicable): $40 to $50 every 14 days
Ignition interlock device (if ordered for restricted permit):
- Installation: approximately $80
- Monthly lease: $103 (includes $30 state participation fee)
- Sheriff's inspection: $40 initial, then $20 every 60 days
- Removal: approximately $40
- Typical 6-month interlock period total: approximately $800
Payment Plans
If you can't pay fines and court costs in full at sentencing, ask the court for an extension. If an extension is granted, visit the Clerk of Courts office to set up and sign a payment plan. The payment schedule and consequences of missed payments depend on the court and the terms of the order; do not assume a plan is automatic.
