An FTA Hits Your License and Your Criminal Record

Missing a court date for a traffic citation in South Dakota triggers two separate consequences. First, the court notifies the DPS to suspend your driver's license under SDCL 32-12-49. Second, the judge may issue an arrest warrant for failure to appear.

The license suspension alone is serious enough. But the arrest warrant adds a layer that many drivers don't expect: you can't resolve this one online. Why the Online Payment Portal Won't Work

When a failure to appear is recorded and a warrant is issued, the court locks the case from electronic payment. This is by design — the court wants you to physically appear or contact the clerk to address the warrant, not just quietly pay the fine from home.

So if you log into UJS ePay and search for your case, you'll either see a notice that payment isn't available or the case won't appear at all. That doesn't mean the debt is gone. It means the court requires you to take action in person or by phone first.

How to Resolve an FTA Step by Step

Step 1: Contact the Clerk of Courts

Call or visit the clerk of courts in the county where the original citation was issued. Explain that you have a failure to appear and need to resolve the warrant. The clerk can tell you whether the judge requires an in-person appearance to quash the warrant or whether you can resolve it administratively.

In many cases — particularly for minor traffic infractions — the court will allow you to pay the original fine plus any additional FTA penalties to clear the warrant without a formal hearing. But this varies by county and judge.

Step 2: Watch the 14-Day Clock

If the court issued a final notification and you didn't pay in full or establish an approved payment plan within 14 days, your debt may have been transferred to the Obligation Recovery Center (ORC). At that point, the clerk can no longer accept payment. You deal with the ORC instead, paying the original balance plus a 20% cost recovery surcharge.

Ask the clerk directly whether the debt is still with the court or has been referred to the ORC. This determines who you pay and how much.

Step 3: Get the Warrant Resolved

Once the fine is paid and the warrant is quashed, the court transmits a clearance to the DPS. This transmission takes 24–48 hours. Don't drive during this window — your license is still technically suspended until the DPS processes the update.

Step 4: Reinstate at the DPS

After the clearance transmits, verify your status on the DPS Eligibility Check portal. Then visit a driver exam station to pay the $75 reinstatement fee plus the $38 application fee.

The Extension Trap

Every day you drive on a suspended license — whether you know about the FTA or not — you risk a Class 2 misdemeanor charge. That carries up to 30 days in jail, a $500 fine, and an automatic one-year extension of your suspension.

Drivers who moved and never received the court's notification are particularly vulnerable. South Dakota mails notices to the address on your license record. If you've moved and didn't update your address with the DPS, you may not know about the FTA until you're pulled over.

What If You Have Multiple FTAs

Each missed court date generates a separate hold. A driver with FTAs in two different counties has two separate warrants and two separate holds to clear. The reinstatement fees may stack as well.
