A critical difference from misdemeanor DUI is that the court-ordered restricted permit pathway under SDCL 32-23-3 requires no prior DUI conviction or chemical test refusal within the preceding five years. A third-offense DUI involves prior convictions, so that pathway is unavailable.

What Reinstatement Requires After the Revocation Period

Once the full revocation period has been served, the reinstatement process involves multiple agencies and compliance requirements:

DPS requirements:

• Reinstatement fee: $200 for third or subsequent DUI offenses (the highest tier under SDCL 32-12-47.1)
• Application fee: $38
• Full retesting: vision screening, written knowledge exam (80% passing score), and practical road skills test — because a revocation cancels the prior license entirely

Insurance requirements:

• SR-22 Certificate of Financial Responsibility filed electronically with the DPS
• Minimum coverage: $25,000/$50,000/$25,000
• Three continuous years of SR-22 maintenance — any lapse triggers an SR-26 cancellation notice and resets the three-year clock to zero

Court-mandated compliance:

• Chemical dependency evaluation completion
• Completion of any court-ordered treatment programs
• 24/7 Sobriety Program compliance (if ordered as a condition of release or probation)
• Satisfaction of all court fines and restitution

Vehicular homicide reinstatement may include sentence-specific conditions. Review the judgment and seek legal advice rather than assuming that the ordinary DUI checklist applies.

The Order of Operations Still Matters

Even with the longer timelines and heavier requirements, the core reinstatement trap applies: paying the DPS reinstatement fee before clearing all external holds wastes money. If outstanding court fines, child support restrictions, or out-of-state pointers remain on your record, the DPS will collect your $238 in fees and still show your license as revoked.

Clear external holds first. File SR-22 second. Pay the DPS and schedule retesting last.
