South Dakota Suspended Imposition of Sentence: How SIS Works for DUI Cases

A Suspended Imposition of Sentence is the best possible outcome for most first-offense DUI defendants in South Dakota. If you complete probation successfully, the charges are dismissed and the record is sealed. But "sealed" in South Dakota doesn't mean what most people think it means, and burning your one-time SIS on a DUI has consequences that can follow you for a decade.

How SIS Works

Under SDCL 23A-27-13, an SIS allows the sentencing judge to accept your guilty plea without entering a formal conviction. Instead of sentencing you, the judge places you on probation — typically six to twelve months — with conditions that usually include:

• A chemical dependency evaluation
• Completion of any recommended treatment programs
• Payment of all fines and court costs
• Maintaining sobriety (often monitored through the 24/7 Sobriety Program)
• No new criminal charges during the probation period

If you satisfy every condition, the case is dismissed and the public record is sealed. Employment background checks won't show a DUI conviction.

The Lifetime Limit

Under SDCL 23A-27-14, you get exactly one misdemeanor SIS and one felony SIS in your lifetime in South Dakota adult courts. Use your misdemeanor SIS on a DUI and it's gone. If you later face an assault charge, a theft charge, or any other misdemeanor, the SIS option isn't available.

This is a calculation worth making carefully with an attorney. An SIS can keep the conviction off public-facing employment background checks, but it does not automatically clear the administrative driving record held by the DPS. Spending it on a DUI means it won't be there for a future situation that might need it more.

The 10-Year Lookback Trap

Here's what "sealed" actually means for DUI purposes: the nonpublic record is permanently maintained by the Division of Criminal Investigation. If you get another DUI within ten years, prosecutors can unseal the SIS and use it to enhance the new charge to a second-offense DUI.

A second-offense DUI carries significantly harsher penalties — longer license revocations, mandatory jail time, and the loss of any remaining SIS eligibility. The sealed record doesn't protect you from sentence enhancement; it only keeps the conviction off public-facing background checks.

SIS Does Not Fix Everything

Several critical gaps that catch people off guard:

Driving record: An SIS does not automatically clear the administrative driving record held by the DPS. The revocation still appears on your driver history even if the criminal case is sealed.

CDL holders: Federal regulations prohibit masking commercial driver violations. An SIS cannot prevent a mandatory one-year CDL disqualification. Commercial drivers should consult a specialized CDL defense attorney before accepting any plea arrangement.

Immigration: Federal immigration authorities do not recognize state-level record sealing. A guilty plea entered to secure an SIS is still classified as a "conviction" for immigration purposes. Non-citizens should consult an immigration attorney before entering any plea.

Insurance: Your auto insurer may still be aware of the arrest and the SR-22 filing, even if the conviction is later sealed. Premium increases related to the SR-22 requirement persist for the full three-year filing period regardless of the SIS outcome.

Getting an SIS

An SIS isn't automatic — the judge decides whether to grant it. Having a completed chemical dependency evaluation and evidence of proactive treatment compliance strengthens your case significantly. Most defense attorneys recommend completing the evaluation before the sentencing hearing rather than waiting for a court order.
