What Virginia's Clean Slate Act Actually Changes

Virginia's Clean Slate Act took effect on July 1, 2026, creating two parallel tracks for criminal record relief: automatic sealing of eligible misdemeanor convictions and a petition-based pathway for additional records.

Automatic sealing begins on October 1, 2026, covering eligible misdemeanor convictions including petit larceny, trespass, and marijuana distribution. The state court system identifies qualifying records and restricts them from public view without requiring any action from the individual.

The petition-based track, which opened July 1, 2026, allows individuals to file for sealing of misdemeanors and certain low-level felonies. Court filing fees have been eliminated for this process, removing a financial barrier that previously blocked many applicants.

The Date Cutoff You Need to Know

Virginia's law only applies to convictions or deferred charges with offense dates on or after January 1, 1986. If your conviction predates that cutoff, you're ineligible for sealing under the Clean Slate Act regardless of how minor the offense was.

This date restriction affects a meaningful number of people — anyone with a conviction from the early 1980s or earlier must pursue alternative relief paths. For older convictions that fall outside the statute's reach, a governor's clemency petition remains the available option.

What's Permanently Excluded

The law draws clear lines around what qualifies. Class 1 through Class 4 felonies are permanently excluded from both automatic and petition-based sealing. That means serious violent crimes, major drug trafficking offenses, and similar high-level felonies will never be eligible for Clean Slate relief in Virginia.

Active supervision or pending charges also create barriers. If you're currently on probation, parole, or have an open case, your waiting period doesn't start until those are fully resolved. Any new conviction resets the eligibility clock.

When You Still Need a Pardon

Virginia's Clean Slate Act is a significant step forward, but it leaves substantial gaps. If your situation falls into any of these categories, executive clemency may be your remaining path:

Convictions predating 1986. The date cutoff is absolute — no petition or automatic process covers these records.

Class 1–4 felonies. The most serious offenses are excluded entirely. A pardon won't erase the record either, but it can restore civil rights and remove mandatory licensing barriers that the conviction created.

Professional licensing barriers. Even after sealing, some Virginia state licensing boards retain authority to access sealed records during their review process. A pardon provides a stronger signal of rehabilitation to boards that exercise broad discretionary authority over applicants with criminal histories.

Civil rights restoration. Automatic sealing hides the record from public view, but it doesn't restore voting rights (which Virginia handles through a separate gubernatorial restoration process) or firearm rights. A pardon addresses rights restoration in a way that sealing alone cannot.

The Ghost Records Problem

Private background check companies buy bulk court data and may continue displaying records that Virginia has sealed. These "ghost records" show up on employment and tenant screenings even though the court file is legally restricted.

Under the Fair Credit Reporting Act and the CFPB's 2024 advisory opinion, commercial background check agencies are required to accurately reflect the sealed status of any record they report. If a sealed record appears on a private background check, you have the right to dispute it directly with the reporting agency and file a complaint with the CFPB if they don't correct it.
