Wyoming DUI Assessment and Treatment Requirements

The Assessment Is Mandatory, Not Optional

Every first-offense DUI in Wyoming requires a substance abuse evaluation before the court will impose a sentence. This isn't a suggestion from your probation officer — it's a statutory requirement. The court needs the evaluation results to determine what level of treatment or education to order.

The evaluation uses a standardized clinical tool called the Addiction Severity Index (ASI). It must be administered by a clinician certified through the Wyoming Department of Health's Behavioral Health Division (BHD).

How the ASI Evaluation Works

The ASI is a structured clinical interview that covers seven areas: medical status, employment, alcohol use, drug use, legal status, family/social relationships, and psychiatric health. A certified evaluator conducts the interview, scores the results, and writes a recommendation.

Based on the ASI results, the evaluator recommends one of several levels of intervention:

• Level 0.5 — Early Intervention: An 8-hour DUI education class, the minimum for most first offenders
• Level 1.0 — Outpatient Treatment: More intensive program (12–24+ hours) for those showing higher risk
• Higher levels: Intensive outpatient or residential treatment for severe substance use disorders

The court uses the evaluator's recommendation to set treatment conditions as part of sentencing or probation.

Where to Find a BHD-Certified Evaluator

The Wyoming Department of Health's Behavioral Health Division maintains a directory of certified providers. You can find evaluators through the BHD's DUI Services page or the Behavioral Health Division's provider certification portal.

The cost difference between providers is dramatic:

Confirm the provider's current fee and BHD certification before booking the assessment.

The DUI Education Class

After the evaluation, most first offenders are directed to a Level 0.5 Early Intervention class — typically an 8-hour program administered by an ADSAP (Alcohol and Drug Safety Action Program) certified provider.

These classes cover alcohol's effects on driving, Wyoming DUI laws, decision-making skills, and relapse prevention concepts. They're not therapy — they're structured education sessions designed to meet the court's requirement.

Costs range from $200 to $500 depending on the provider and format. Some providers offer condensed weekend formats; others spread sessions across multiple evenings.

If the ASI evaluation recommends a higher level of care (Level 1.0 outpatient or above), the treatment program is longer and more expensive. The court follows the evaluator's recommendation, so the ASI results directly determine your time and financial commitment.

The Sequence Matters

There's a specific order to this process:

1. Get a court or probation assignment — the court orders the evaluation, or your probation officer provides the referral
2. Complete the ASI evaluation — schedule with a BHD-certified evaluator and attend the interview
3. Enroll in the recommended program — register for the class or treatment program the evaluator recommended
4. Complete the program and get documentation — your provider issues a completion certificate
5. Submit proof to the court and WYDOT — both entities need to see completion documentation, and they don't communicate with each other automatically

For probationary license applicants, the substance abuse assessment and DUI course enrollment are prerequisites — WYDOT won't issue the restricted license without them.

Victim Impact Panel

Separately from the assessment and education requirements, the court typically orders attendance at a Victim Impact Panel. MADD (Mothers Against Drunk Driving) runs approved panels both in-person and online. Costs range from $30 to $65.

The Victim Impact Panel is a one-time attendance requirement. It doesn't replace the ASI evaluation or the DUI education class — it's an additional condition.
