Two Separate Systems Are Now Working Against You

A first DUI in Kentucky triggers a dual-track process that catches almost everyone off guard. The District Court handles the criminal case — fines, possible jail time, treatment programs. The Kentucky Transportation Cabinet handles your license — suspension, the ignition interlock program, and eventual reinstatement. These two systems operate on separate timelines with different deadlines, and failing to coordinate them is how people end up suspended longer than they need to be.

Under KRS 189A.010, a first offense within a ten-year lookback is classified as a Class B misdemeanor. The lookback counts from offense dates, not conviction dates.

Criminal Penalties: What the Court Can Do

For a standard, non-aggravated first offense:

• Fine: $200 to $500, plus court costs ($150–$200) and a mandatory $425 DUI service fee under KRS 189A.050
• Jail: 48 hours to 30 days — but judges routinely allow 48 hours to 30 days of community labor instead of physical incarceration
• Treatment: A 90-day substance abuse education program through a facility certified by the Cabinet for Health and Family Services, starting with a mandatory $100 clinical assessment

Community labor is a real option for most first-offense cases. You perform supervised work at pre-approved governmental or charitable organizations instead of sitting in a cell.

When the Penalties Get Worse

Six statutory aggravating circumstances double the mandatory minimum jail time to four days, which must be served day-for-day. No community labor, no probation, no suspended sentence for those four days. The aggravators are:

• BAC of 0.15 or higher
• Refusing a chemical test
• Speeding more than 30 mph over the limit
• Wrong-way driving on a limited-access highway
• Causing an accident with death or serious injury
• A child under 12 in the vehicle

If any one of these applies, the minimum jail time doubles and cannot be avoided.

The License Suspension

The KYTC imposes a static six-month suspension for a first-offense DUI conviction. This replaced the older court-discretionary model of 30 to 120 days. The only way to reduce it is through the Kentucky Ignition Interlock Program (KIIP): install a certified breathalyzer in your vehicle, drive violation-free for 90 consecutive days, and the suspension drops to four months.

The interlock license (under KRS 189A.340) lets you drive at any time and for any purpose while the device is installed. This is different from a hardship license, which is far more restrictive and unavailable to anyone who refused a chemical test.

If you refused a chemical test at the time of arrest, the judge will suspend your license at arraignment — before the criminal case is even resolved. You have 30 days to file a motion for judicial review of that pretrial suspension.

What It Actually Costs

The total out-of-pocket for a first-offense DUI in Kentucky runs between $1,500 and $3,500 before counting legal representation or increased insurance premiums. The mandatory costs that cannot be avoided:

The $425 service fee alone — which funds forensic labs, state police, public defenders, and the interlock administration — is often a surprise at sentencing.

The Path Back to a Full License

Reinstatement requires clearing both tracks:

1. Serve the suspension period (or complete KIIP for the reduced term)
2. Complete the mandatory substance abuse education program — in person, at a state-certified facility (online courses do not satisfy Kentucky requirements)
3. Verify that the treatment provider submitted your Certificate of Completion to the KYTC
4. Pay the $40 reinstatement fee at a Driver Licensing Regional Office
5. If suspended for more than one year, pass written and vision tests
