What Has to Happen Before Reinstatement

License reinstatement after a Kentucky DUI is not automatic. The suspension does not simply expire and give you your license back. You must satisfy specific requirements from both the court system and the Kentucky Transportation Cabinet, and then physically visit a KYTC Driver Licensing Regional Office to get your license reissued.

The requirements fall into three categories: time served, treatment completed, and fees paid.

The Suspension Period

A first-offense DUI conviction triggers a static six-month suspension administered by the KYTC. This is not the older 30-to-120-day court-discretionary model — that was repealed.

The suspension can be reduced to four months through the Kentucky Ignition Interlock Program (KIIP). To qualify for the reduction, you must complete 90 consecutive days of violation-free driving with the interlock device installed. The 90-day clock starts on the date the restricted license is physically issued at a KYTC Regional Office, not on the date the device is installed or the date of conviction.

If you chose not to participate in KIIP (or were unable to), you must wait out the full six months without driving.

Treatment Completion

You must complete the mandatory substance abuse education program ordered by the court. This involves:

1. A face-to-face clinical assessment ($100) at a CHFS-certified provider
2. The recommended education or treatment program (typically a 20-hour education program costing $300–$500)

The treatment provider submits a Certificate of Completion electronically to the KYTC Division of Driver Licensing. The KYTC will not process your reinstatement until this certificate is in their system. Confirm with your provider that the transmission has been sent — do not assume it happened automatically.

The Reinstatement Fee

The reinstatement fee is $40, paid to the Kentucky State Treasurer at a KYTC Driver Licensing Regional Office. This can be paid online in some cases or in person. The fee is the same regardless of whether you participated in KIIP or waited out the full suspension.

Retesting Requirements

If your license has been suspended for more than one year, you must pass written and vision tests before reinstatement. The tests are administered by the Kentucky State Police at the Regional Office.

For a standard first-offense case with a six-month suspension (or four months with KIIP), retesting is not required. The one-year threshold typically applies only to cases with extended suspension — second offenses, failure-to-comply extensions, or long gaps between suspension and reinstatement.

Step-by-Step Reinstatement Process

1. Confirm suspension period completion. Verify with the KYTC (by calling the Division of Driver Licensing Court Records section at (502) 564-1257 or checking through mydrive.ky.gov) that your suspension period has been served or that your KIIP 90-day compliance has been credited.

2. Confirm treatment certificate is on file. Call the KYTC or check online to verify that your CHFS-certified provider submitted the Certificate of Completion. If it is not on file, contact your provider.

3. Verify no outstanding court obligations. Unpaid court fines, the $425 DUI service fee, or other financial obligations can block reinstatement. Contact the District Court clerk's office to confirm your account is clear.

4. If you were in KIIP, get the device removed. After completing the compliance period, the KYTC issues a Letter of Removal. Take it to your interlock vendor to have the device removed and receive a Certificate of Removal.

5. Visit a Regional Office. Bring the Certificate of Removal (if applicable), your proof of insurance, and a form of identification. Pay the $40 reinstatement fee. The Regional Office will print your standard, unrestricted license.

6. Pass retesting if required. Only if your suspension exceeded one year — written and vision tests at the Regional Office.

How Long the Full Process Takes

For a driver who starts the KIIP and treatment program immediately after conviction:

• KIIP compliance period: 90 days minimum
• Treatment program: 7–8 weeks for the 20-hour education program (can run concurrently with KIIP)
• Total time to reinstatement: approximately four months from conviction

For a driver who does not participate in KIIP:

• Full suspension period: six months
• Treatment program: must be completed before reinstatement
• Total time: six months minimum, plus any time needed to finish the treatment program if started late

The single biggest reinstatement delay is starting the treatment program too late. If you wait until month five to begin a seven-week education program, reinstatement gets pushed past the six-month mark even though the suspension has technically ended.
