Maryland Child Support License Suspension: How It Works and How to Get Driving Again

When Maryland Suspends Your License for Child Support

The Child Support Administration (CSA) — not the MVA — initiates license suspensions for unpaid child support. The MVA acts only as the enforcement mechanism that actually disables your credential.

Under revised statutes effective October 1, 2025, the trigger threshold is 120 consecutive days of delinquent payments. Once your account crosses that line, the CSA issues a formal written notice informing you that a license suspension referral is pending.

This is the single most important piece of mail in the process. You have a narrow window — typically 30 days — to respond before the suspension takes effect.

The 250% Federal Poverty Level Exemption

Maryland law includes an income-based protection for low-income parents. If your documented personal income is at or below 250% of the Federal Poverty Level (FPL), you are shielded from license suspension for child support delinquency.

The applicable dollar threshold changes with the federal poverty guidelines. Use the current 250% FPL figure when documenting income rather than relying on a fixed amount.

To claim this exemption, you must submit a formal Request for Driver's License Suspension Review along with proof of income — pay stubs, tax returns, or documentation of public benefits. The review window is the same 30-day period after the CSA's initial notice.

One critical exception: the income exemption is voided if a court has formally ruled that you are "voluntarily impoverished" — meaning a judge has determined you are deliberately earning less to avoid child support obligations. If that ruling exists on your case, the income exemption will not protect your license.

Grounds for Contesting the Suspension

Beyond the income exemption, you can contest the CSA's referral on these grounds:

• Inaccurate information: The delinquency calculation is wrong, payments were applied to the wrong account, or the 120-day count includes periods where you were in compliance
• Extreme hardship: Losing your license would directly prevent you from maintaining employment or attending required medical treatment

You must submit documentation supporting your position within the review window. The CSA reviews the submission and either withdraws the referral or proceeds with the suspension.

Getting a Work-Restricted License (Restriction Code "H")

If the suspension is already active and you cannot get it fully lifted immediately, there is a middle path: the work-restricted license.

The process:

1. Contact your local child support agency to arrange a payment agreement or begin paying down the arrears
2. If the agency accepts a partial payment plan, request a Work-Restricted Driver's License Authorization letter from the CSA
3. Take the authorization letter to an MVA branch to obtain a work-restricted license

The physical credential will display restriction code "H," which limits you to driving directly to and from your place of employment, or during the active course of employment. This is strictly enforced — driving to the grocery store on the way home from work technically falls outside the restriction.

The work-restricted license is a critical lifeline because the alternative — not driving and losing your job — makes it even harder to catch up on child support payments.

Full Reinstatement After Clearing the Arrears

Once you reach full compliance with your child support obligations, the CSA transmits an electronic clearance to the MVA. At that point, you can visit an MVA branch, pay the licensing fee, and obtain an unrestricted credential.

A partial payment plan can support the CSA authorization for a work-restricted license, but do not assume it will produce an unrestricted clearance. The CSA must confirm full compliance and transmit electronic clearance before you seek the unrestricted credential.

Why Sequence Matters With Child Support Holds

A child support suspension blocks the MVA from issuing any form of physical credential. That includes restricted licenses for other suspension types and ignition interlock licenses. If you have a DUI-related interlock requirement and a child support hold simultaneously, the child support hold must be addressed first — installing an interlock device is pointless if the MVA cannot issue you the "J" restricted license to go with it.
