Massachusetts Child Support License Suspension
This Is the One Suspension Where a Hardship License Doesn't Exist
Most Massachusetts license suspensions offer at least the possibility of a Cinderella license — a restricted hardship permit that lets you drive during specific hours for work, school, or medical treatment. Child support suspensions are the exception. Under G.L. c. 90 § 22(g), a license suspended for child support delinquency is absolute: no hardship license, no administrative workaround, no Board of Appeal override.
The Department of Revenue (DOR) Child Support Services Division has the authority to direct the RMV to indefinitely suspend your license when you fall behind on support obligations. The suspension remains active until the DOR — not the RMV, not a court — transmits an electronic clearance. The RMV cannot override this hold under any circumstances.
How the Suspension Gets Triggered
The suspension is tied to child support delinquency, and the DOR's enforcement process determines when the matter is referred to the RMV. Do not assume that a particular number of missed payments automatically triggers a license suspension.
Once the DOR decides to suspend, it sends an electronic directive to the RMV. The RMV mails a suspension notice giving you 10 days to pay the child support obligation; if you do not pay by the date listed, the RMV suspends or revokes your license until the obligation is satisfied.
The Only Two Paths to Reinstatement
Path 1: Pay the arrears in full. If you can afford to bring your child support account completely current, the DOR will transmit an electronic clearance to the RMV. Once the clearance is received, you pay the $100 RMV reinstatement fee, and the hold is lifted.
Path 2: Establish an approved payment agreement. If paying the full arrears isn't financially possible, contact the DOR Child Support Services Division to negotiate a payment agreement. After approving the agreement, the DOR may transmit a clearance to the RMV. The specific terms — monthly amount, duration, consequences of default — vary based on your income, the arrearage amount, and your payment history.
In either case, the key step is getting the DOR's electronic clearance transmitted to the RMV. The RMV has no mechanism to independently verify your child support status — it can only act on what the DOR sends.

Why This Hold Must Be Cleared First
If you have multiple active suspensions — say, a child support hold plus a court default plus an OUI suspension — the child support hold must be cleared before the RMV can accept a reinstatement fee or schedule a hearing. The DOR's electronic clearance is required for those RMV actions.
This is the "payment trap" that catches drivers off guard. You can pay the RMV reinstatement fee for your OUI suspension, complete your 24D program, and gather every document the Board of Appeal requires — but if the DOR child support hold is still active, your license status won't change. You've spent money and time resolving the wrong hold first.
The correct sequence: resolve the DOR hold first, then tackle court defaults, then program completions, then RMV fees for the remaining suspension events. Getting this order wrong can waste fees and time.
Modification vs. Reinstatement
If your child support obligation is set higher than your current income can sustain, ask the Probate and Family Court or a qualified lawyer whether a Complaint for Modification is appropriate. A modification does not itself clear the existing arrears or lift the suspension.
Filing for modification is a separate legal proceeding from the DOR's enforcement actions; filing alone does not change the RMV clearance requirement.
