Massachusetts Ignition Interlock Device: Requirements, Costs, and Removal

Who Needs an Ignition Interlock in Massachusetts

Massachusetts mandates an IID for two categories of drivers:

Multiple OUI offenders: Any driver with two or more OUI offenses on their lifetime driving record — including CWOFs, 24D dispositions, and out-of-state convictions — must install an IID to obtain a hardship license or to reinstate after serving the full revocation period. The minimum program duration is two years.

High-BAC first offenders: Under the 2020 amendments to Melanie's Law (Chapter 227 of the Acts of 2020), first-time OUI offenders who registered a blood alcohol concentration of 0.15 or higher at arrest must install an IID if they receive a hardship license. The device stays for the duration of the hardship period.

The IID must be installed in every vehicle you own, lease, or operate — including employer-provided vehicles. If you have two cars, both get devices. If your employer provides a work truck, that gets one too.

What It Costs

IID expenses add up quickly and run for the entire program period:

• Installation: $75–$150 per vehicle (one-time, per device)
• Monthly lease and monitoring: $75–$105 per vehicle ($2.50–$3.50/day)
• Monthly calibration service visit: Included in lease or $25–$50 additional, depending on vendor
• Removal: $50–$100 per vehicle

For a single vehicle over the minimum two-year program period, the total IID cost runs approximately $1,925–$3,970. For two vehicles, roughly double. These costs are on top of reinstatement fees, treatment program costs, and any legal expenses.

Daily Operation Rules

The IID isn't a one-time test at the start of your day. It requires ongoing compliance every time you drive:

Startup test: Before the engine will start, you must provide a breath sample that registers below 0.02 BAC. Not 0.08 — 0.02. A single glass of wine with dinner could put you above this threshold hours later.

Rolling retests: Once the vehicle is moving, the device randomly beeps and demands another breath sample. You have exactly five minutes to provide the test. Missing a rolling retest triggers a lockout.

Monthly calibration: Every 25–30 days, you must bring the vehicle to your approved IID vendor for mechanical calibration and data upload. The vendor transmits your device data to the RMV. Missing a calibration window triggers a lockout.

Lockouts and What Triggers Them

A lockout disables the vehicle's ignition. Four things trigger one:

1. A failed startup breath test (BAC at or above 0.02)
2. A missed rolling retest
3. A missed monthly calibration appointment
4. Detected physical tampering or circumvention attempt

Once locked out, you have 48 hours to bring the vehicle to your IID vendor for a reset. If you don't make it within 48 hours, the device enters permanent lockout — the ignition is completely disabled, and the vehicle must be towed to the vendor at your expense.

Program Violations and Their Consequences

The RMV monitors all uploaded IID data under 540 CMR § 25.00. These events count as program violations:

• One failed rolling retest at 0.05 BAC or higher
• Two failed rolling retests between 0.02 and 0.05 within a single monthly service period
• Two lockouts (from missed retests or failed startups) over the life of the program
• Two missed calibration visits over the life of the program
• Any evidence of tampering, bypass attempts, or operating a non-equipped vehicle

The consequences for a violation are extreme. The RMV suspends your license immediately and schedules an Ignition Interlock Violation Hearing. If the RMV finds you responsible:

• First violation: Mandatory 10-year license revocation
• Subsequent violation: Lifetime license revocation

Operating a vehicle without an IID while restricted is a separate felony under G.L. c. 90, § 24S — mandatory minimum 150-day jail sentence and up to $15,000 in fines.

Getting the IID Removed

The IID restriction doesn't automatically expire when your program period ends. Removal requires a formal process:

1. Contact your IID vendor to request a copy of the device record and schedule a removal hearing
2. Attend a telephone hearing with the RMV's Ignition Interlock Department. The hearings officer audits the previous six months of device data. Any lockout, failed test, or program infraction in the last six months means denial — and you stay on the program for another six months.
3. If approved, log into myRMV and complete a "Replace My Driver's License" transaction ($25 fee) to receive a new physical license with the "T" restriction removed
4. Present the new unrestricted license to your IID vendor to authorize physical removal of the device

Only days when you hold an active, valid license count toward the required 730-day minimum program period. If your license was suspended, expired, or inactive during any part of the program, those days don't count and the program extends accordingly.

False Positives

Mouthwash, hand sanitizer, certain medications, and even some foods can produce a breath sample that registers above 0.02. If you believe a failed test was caused by environmental factors rather than alcohol consumption:

• Rinse your mouth with water and wait several minutes before retesting on a rolling retest
• For a startup failure, wait 15 minutes and try again — most environmental readings clear within minutes while actual alcohol readings don't

If a false positive is recorded and reported to the RMV, you must present evidence — such as a contemporaneous blood test from a hospital or police station — and file an appeal within 30 days. Because a single violation can trigger a 10-year revocation, this is one area where legal representation is strongly recommended.
