Massachusetts OUI License Reinstatement: Fees, Timelines, and Required Steps

OUI Suspension Lengths by Offense Number

Massachusetts counts OUI offenses across your entire lifetime under Melanie's Law — there's no washout period. A first offense from 1998 counts as your first, and one in 2026 becomes your second. Out-of-state convictions, Continuances Without a Finding (CWOF), and 24D program assignments all count toward the lifetime tally.

Here's what each offense level means for your license:

  • First offense (24D disposition): 45–90 day suspension. Eligible for a hardship license immediately upon enrolling in an approved alcohol education program.
  • First offense (trial conviction): 1-year suspension. Hardship eligible after serving 3 months.
  • Second offense: 2-year revocation. Hardship eligible after 1 year. Ignition interlock device required.
  • Third offense: 8-year revocation. Hardship eligible after 2 years. IID required. Requires DCU Director review.
  • Fourth offense: 10-year revocation. Hardship eligible after 5 years. IID required.
  • Fifth or subsequent offense: Lifetime revocation. No hardship eligibility.

The CWOF Distinction

A Continuance Without a Finding feels like a win in court — you're not technically "convicted." But for RMV purposes, a CWOF on an OUI charge triggers the same administrative suspension as a guilty verdict. The RMV treats a CWOF as a 24D program assignment, which means a 45–90 day suspension and mandatory enrollment in the alcohol education program.

More critically, a CWOF counts as a lifetime offense. If you received a CWOF on a first OUI twenty years ago and face a new OUI charge today, the RMV counts the new charge as a second offense — triggering a 2-year revocation, not a 45-day suspension. This surprises many drivers who assumed their CWOF would fade from their record.

Required Treatment Programs

Every OUI reinstatement requires proof of completing a substance abuse program. The specific program depends on your offense number:

First offense (24D): The 16-week Driver Alcohol Education (DAE) program, administered by a DPH-approved provider. You must provide a formal completion letter on program letterhead.

Second offense: A 14-day inpatient treatment program at a DPH-approved facility. You need both a completion letter and a discharge summary assessing recidivism risk, plus documentation of compliance with any ordered aftercare.

Third or fourth offense: A minimum 90-day inpatient treatment program. The documentation requirements are the same as second offense but with stricter scrutiny of aftercare compliance.

If you're on probation, you'll also need a clearance letter from your probation officer dated within 30 days of any RMV hearing.

Reinstatement Fees

OUI reinstatement fees are per-event, not per-offense:

  • First offense: $500
  • Second offense: $700
  • Third or subsequent: $1,200

These fees stack with other suspension types on your record. If you have an OUI plus a court default plus an out-of-state hold, you're paying three separate reinstatement fees.

The Ignition Interlock Requirement

An IID is mandatory for two categories of drivers:

  1. Any driver with two or more lifetime OUI offenses seeking reinstatement or a hardship license
  2. First-time offenders with a BAC of 0.15 or higher who receive a hardship license

The device must be installed in every vehicle you own, lease, or operate. Monthly calibration visits are required every 25–30 days. The minimum IID program duration is two years for multiple offenders, and only days with an active license count toward that total.

Violating the IID program — failing a breath test, missing calibration, or driving a non-equipped vehicle — triggers immediate suspension and can result in a 10-year revocation for a first violation or lifetime revocation for subsequent violations. Operating a vehicle without an IID while restricted is a felony under G.L. c. 90, § 24S, carrying a mandatory minimum 150-day jail sentence.

The Full Reinstatement Sequence

  1. Complete your required treatment program and collect the completion certificate
  2. Obtain probation clearance if applicable (letter dated within 30 days)
  3. Clear any concurrent suspensions on your record (court defaults, child support, out-of-state holds)
  4. Attend your RMV hearing or Board of Appeal hearing
  5. Install the ignition interlock device if required
  6. Pay all reinstatement fees
  7. Retake written and road tests if your license has been inactive for 2+ years
  8. Verify your license status shows "Active" through myRMV before driving
