DUI Sealing Is a Separate Track Entirely

If you have a DUI or Actual Physical Control (APC) conviction in North Dakota and you've been researching the standard record sealing process under Chapter 12-60.1, you can stop — that statute explicitly excludes DUI and APC offenses. DUI record sealing has its own separate statute: N.D.C.C. § 39-08-01.6.

The requirements, timeline, and exclusions are different from standard conviction sealing, and there's one hard disqualification that catches a lot of people.

The Three Requirements for DUI Sealing

Under § 39-08-01.6, a court is required to seal a DUI or APC conviction if all three of these conditions are met:

1. The offense occurred after December 31, 2004: DUI convictions from before 2005 are not eligible for sealing under this provision
2. Seven years conviction-free: You haven't pled guilty, nolo contendere, or been found guilty of a subsequent DUI, APC, or any other criminal offense within seven years of the first violation
3. You don't hold a CDL: You must not hold a commercial driver's license under N.D.C.C. § 39-06.2-10

Note the language: if all three conditions are met, the court must seal the record. This differs from standard conviction sealing because the statute sets specific criteria rather than the standard balancing test. Meet the criteria and the sealing is mandatory.

The CDL Exclusion

This is the hard stop that hits hardest in North Dakota's economy. The state relies heavily on trucking for agricultural and energy logistics. Commercial Driver License holders who pick up a DUI are excluded from this sealing provision while they hold a CDL.

The seven-year waiting period does not remove this exclusion. If you hold a CDL, § 39-08-01.6 sealing is unavailable.

This exclusion applies regardless of whether the DUI occurred while driving a commercial vehicle or a personal car. The statute's condition is that the individual not hold a CDL.

Deferred Imposition Isn't Available Either

Another important exclusion: North Dakota law prohibits courts from granting deferred impositions for DUI and APC offenses under N.D.C.C. § 39-08-01. The automatic plea-withdrawal-and-sealing mechanism under Rule 32.1 — which works for other misdemeanors — simply doesn't apply to DUI cases.

Felony DUI Complications

A fourth or subsequent DUI offense in North Dakota is a Class C felony under § 39-08-01. This creates additional complications:

• As a felony, it triggers a federal and state firearm prohibition under N.D.C.C. § 62.1-02-01
• The firearm ban cannot be resolved by a standard record-sealing order
• The conviction still needs to meet the § 39-08-01.6 requirements (post-2004, seven years clean, no CDL) for sealing

What DUI Sealing Accomplishes

A sealed DUI conviction is removed from public court searches and generally won't appear in current standard commercial background checks. Employers and landlords using third-party screening services may still have an outdated copy.

But as with all North Dakota sealing:

• The BCI's criminal history database remains intact — law enforcement and prosecutors still see the DUI
• Licensing boards with fingerprint-check authority still see it
• The DMV driving record is a separate system — DUI sealing covers the criminal court record, but your driving history may still reflect the offense

Prosecutors also retain access for sentencing enhancement purposes. If you pick up a new DUI after sealing, the prior sealed conviction can still be used to escalate the new charge.

The Practical Path

If you meet the three criteria — post-2004 offense, seven years clean, no CDL — your path is straightforward because sealing is mandatory. You still need to petition the court, and you'll want certified records confirming your conviction-free period. The statute sets specific criteria rather than the discretionary balancing test used for standard conviction sealing.
