SR-22 Insurance After a Maine OUI: Requirements, Cost, and When It Applies
The Short Answer: Most First-Offense OUI Drivers Do Not Need SR-22
Maine does not require SR-22 financial responsibility filings for a standard first-offense OUI. If you submitted to the chemical test, were convicted of a first offense with no other complications, and are working through the reinstatement process, the BMV will not require an SR-22 as a condition of getting your license back.
This is a meaningful distinction from many other states and from Maine's own treatment of repeat offenses. Second and subsequent OUI convictions in Maine do require mandatory SR-22 filings for reinstatement.
When SR-22 Is Required on a First Offense
There are specific circumstances where a first-offense OUI in Maine will trigger an SR-22 filing requirement, even though the OUI alone would not:
Uninsured accident involvement: If your OUI arrest involved a motor vehicle accident and you were operating an uninsured vehicle at the time, the BMV's Financial Responsibility Division will mandate a three-year SR-22 filing as a condition of reinstatement. The SR-22 proves to the state that you carry at least the minimum required liability insurance going forward.
Other financial responsibility triggers: Certain traffic violations or judgments that coincide with the OUI — such as an at-fault accident with an unpaid judgment — can independently trigger SR-22 requirements under Maine's financial responsibility statutes, separate from the OUI penalties.
If you are unsure whether your specific situation triggers an SR-22 requirement, check with the BMV's Financial Responsibility Division directly.
What SR-22 Filing Costs
If you do need to file:
- Insurer filing fee: $20–$50 (a one-time fee your insurance company charges to file the SR-22 form with the state)
- Filing duration: Typically 3 years from the date of reinstatement
- Lapse consequences: If your SR-22 policy lapses or is cancelled during the required filing period, your insurer must notify the BMV, which will immediately re-suspend your license
The SR-22 is not a separate insurance policy — it is a form your existing insurer files with the BMV certifying that you carry continuous liability coverage. You need to maintain uninterrupted coverage for the full filing period.

The Insurance Increase That Hits Everyone
While most first-offense OUI drivers avoid the SR-22 filing, no one avoids the insurance rate increase. An OUI conviction signals to insurers that you are a high-risk driver, and premiums go up accordingly — regardless of whether an SR-22 is required.
Average annual premium increases after a Maine OUI conviction range from $1,266 to $3,900 per year, depending on your insurer, your prior driving record, and your coverage levels. These elevated rates typically persist for 3 to 5 years. Over that period, the insurance cost alone can exceed $3,800 to $11,700.
Some strategies to manage the increase:
- Shop multiple carriers. Rate increases vary significantly between insurers. Some specialize in high-risk drivers and offer more competitive post-OUI pricing
- Increase deductibles to lower your premium, if you can absorb higher out-of-pocket costs in the event of a claim
- Ask about discounts for defensive driving courses, bundling policies, or clean driving after reinstatement
SR-22 vs. FR-44: Maine Uses SR-22
Some states (Virginia and Florida, notably) require an FR-44 form for DUI-related offenses, which mandates higher liability limits than a standard SR-22. Maine does not use the FR-44. If an SR-22 is required, it certifies coverage at Maine's standard minimum liability limits.
One Piece of a Larger Process
Whether or not you need an SR-22, the insurance increase is one of the largest long-term costs of a Maine OUI. Understanding where it fits alongside court fines, DEEP fees, interlock costs, and BMV reinstatement charges helps you plan realistically for the total financial impact. Our Maine First-Offense DUI Guide includes a complete cost breakdown and walks through every step of the reinstatement process, including when and how insurance requirements come into play.
