Texas Child Support License Suspension

A child support suspension in Texas operates differently from almost every other type of license hold. The enforcement comes from the Office of the Attorney General, not DPS. The resolution requires negotiating directly with the OAG Child Support Division. And unlike a DWI or unpaid-ticket suspension, you cannot get an Occupational Driver's License to keep driving while you work things out.

That last point is what makes this particular suspension so financially devastating — you lose your ability to drive to work at the same time you need to be earning money to pay the support you owe.

How the Suspension Gets Triggered

Under Chapter 232 of the Texas Family Code, the OAG Child Support Division can issue an administrative order or petition a court to suspend all of your state-issued licenses when you meet either of two conditions:

• You owe overdue child support equal to or greater than three months of your ordered payments
• You've failed to comply with an agreed-upon repayment schedule

"All state-issued licenses" means exactly what it sounds like. Your driver's license, any professional or business licenses, and recreational permits (hunting, fishing) all get suspended simultaneously.

When the OAG initiates enforcement, they send you a notice. You have 20 days from the date you receive that notice to request a formal hearing to contest the action. If you don't respond within that window, the suspension takes effect without a hearing.

Why an Occupational License Won't Work

Texas Transportation Code explicitly excludes child support suspensions from ODL eligibility. Courts cannot issue an Occupational Driver's License for a suspension ordered under Family Code Chapter 232. This is one of only a few suspension types (along with medical suspensions) where the ODL safety valve is completely unavailable.

This means there is no legal way to drive in Texas while a child support license suspension is active. The only path forward is resolving the suspension directly with the OAG.

Steps to Reinstate

1. Contact the OAG Child Support Division at 1-800-252-8014. This is the only agency that can release the suspension. DPS cannot lift it — they need an administrative release from the OAG before they'll restore your driving privileges.

2. Negotiate a resolution. The OAG typically requires two things: a lump-sum payment toward the arrears balance and a modified court-ordered repayment schedule that you can demonstrate the ability to maintain. The exact terms depend on your financial situation, the total arrears amount, and your payment history.

3. Establish a consistent payment record. The OAG wants to see that you'll actually follow through. In many cases, they'll require several months of on-time payments under the new schedule before releasing the suspension. The specific timeline varies case by case.

4. Get the administrative release. Once the OAG is satisfied with your payment arrangement and track record, they issue an administrative release to the licensing authority — DPS for your driver's license, TDLR for professional licenses, or TPWD for recreational permits. DPS will not renew or restore your license until this release is received.

5. Check your DPS status. After the OAG transmits the release, verify your eligibility through the DPS License Eligibility Portal. If other holds exist on your record (OmniBase, reinstatement fees, SR-22 requirements), those still need to be resolved separately.

Preventing Future Suspensions

If your income changes — you lose a job, take a pay cut, or face a medical emergency — file a motion to modify your child support order with the court before you fall behind. The modification process takes time, but being proactive is infinitely easier than trying to dig out from three months of arrears with a suspended license.
