Vermont Suspended License for Unpaid Tickets: H.53, Payment Plans, and Reinstatement

For years, Vermont suspended driver's licenses as the primary enforcement tool for unpaid civil traffic fines. That changed in June 2023 with H.53 (Act 19) — but if you're still dealing with a suspension from before the law changed, you're not automatically in the clear. Here's what actually happened and what you need to do.

What H.53 Actually Changed

H.53 eliminated the DMV's authority to issue new license suspensions solely for failing to pay civil traffic violations for which points are authorized. If you get a speeding ticket today and don't pay it, the Vermont Judicial Bureau can pursue collection, but the DMV won't suspend your license over it.

That's the reform. What follows is the part most people miss.

What H.53 Did Not Do

The law did not automatically reinstate licenses already suspended before its effective date. For historical debt-related suspensions, H.53 imposed a 30-day maximum duration. Once those 30 days elapsed, the suspension technically expired. But "expired" doesn't mean "reinstated." You still need to:

1. Resolve the underlying traffic debt with the Vermont Judicial Bureau (pay in full, enter a payment plan, or complete the Civil DLS Diversion Program)
2. Pay the $80 reinstatement fee to the DMV
3. Wait for the DMV to issue an official written Notice of Reinstatement

Until you complete all three, you do not have the DMV's Notice of Reinstatement and are not legally cleared to drive. Driving without that notice is criminal DLS — a misdemeanor carrying fines and potential jail time.

How to Resolve the Underlying Debt

You don't necessarily need to pay everything at once. Three options:

Pay in full online — Go to vtcourts.gov/pay-fine, enter your citation numbers, and pay by credit card. There's a 2.39% convenience fee. This resolves the balance with the VJB; the DMV must still receive and process the clearance.

VJB payment plan — Under 4 V.S.A. § 1109, you're legally entitled to a payment plan capped at $30 per traffic violation judgment per month (maximum $100/month if you have four or more outstanding judgments). Request the plan using Form 500-00423 from vtcourts.gov/self-help/traffic-violations or call the Judicial Bureau at 802-652-1900 or 802-295-8869. Once you're enrolled and maintaining compliance, the VJB sends an electronic clearance to the DMV.

Civil DLS Diversion Program — If you're facing high traffic debt and a suspended license, apply through your local community justice center. A case manager helps you complete a financial affidavit and sets up an affordable contract. Fines may be reduced or exchanged for community service. The program requires a $25 down payment toward a $175 contract fee. Once a VJB Hearing Officer approves compliance, the DMV is notified.

The 75-Day Collections Trigger

One deadline to watch: if you ignore a VJB judgment for 75 days, the court can initiate civil contempt proceedings, offset your Vermont state tax refund, or refer the debt to AllianceOne collections (1-800-858-4506). Getting into a payment plan before that 75-day window closes avoids the escalation.

The Reinstatement Step That Trips People Up

Resolving your debt with the Judicial Bureau does not automatically restore your license. There's an administrative lag between VJB payment processing and the DMV's database update. After the VJB confirms compliance, you still need to pay the $80 reinstatement fee directly to the DMV — through myDMV online, by mail, or in person in Montpelier.

The DMV then issues a written Notice of Reinstatement. That document is what makes you legal to drive again. No notice, no legal driving — regardless of whether you've paid every fine.
