There is no general work exception for suspended drivers in Kentucky. Unless you hold a valid restricted credential — either an ignition interlock license or a judicial hardship license with court-ordered driving hours — operating a vehicle while your license is suspended is a criminal offense.

The consequences escalate quickly depending on why the license was suspended and how many prior offenses you have.

Penalties for Standard Suspensions

For licenses suspended due to court debt, child support, insurance lapses, or point accumulation — essentially any non-DUI cause — driving while the suspension is active violates KRS 186.620 and is a Class B misdemeanor under KRS 186.990(3).

The DUI-specific penalties below are different and apply to a license suspended under KRS Chapter 189A.

Penalties for DUI-Related Suspensions

Driving on a license that was suspended due to a DUI conviction triggers harsher penalties under KRS 189A.090. The charge level depends on prior driving-on-DUI-suspension offenses within a ten-year period:

First offense (driving on DUI suspension): Class B misdemeanor — up to 90 days in jail and a six-month additional license suspension. If the same incident also involves a violation of KRS 189A.010(1)(a)-(e), the offense is a Class A misdemeanor with a one-year suspension.

Second offense: Class A misdemeanor — up to 12 months in jail and a one-year additional license suspension. If the same incident also involves a violation of KRS 189A.010(1)(a)-(e), the offense is a Class D felony with a two-year suspension.

Third or subsequent offense: Class D felony, carrying one to five years in prison and a two-year additional license suspension. If the same incident also involves a violation of KRS 189A.010(1)(a)-(e), the additional suspension is five years.

The new suspension is imposed in addition to the original DUI suspension. If you are otherwise eligible, KRS 189A.090(3) allows you to apply for an ignition interlock license for the remainder of the original suspension and the entire new suspension.

What About Restricted Licenses?

Kentucky does offer limited restricted driving options, but only for specific situations:

Ignition interlock license — available for standard alcohol DUI suspensions. You can drive at any time, for any purpose, but only in vehicles equipped with an approved interlock device, subject to any applicable employer work exemption. This is applied for through the KYTC using Form TC 94-175.

Judicial hardship license — available only for non-alcohol DUI suspensions under KRS 189A.010(1)(c) or (d), and only if you did not refuse chemical testing. Restricts driving to specific routes and hours set by the court.

Neither option is available for non-DUI suspensions. If your license is suspended for unpaid tickets, child support, or insurance lapses, the only path is clearing the underlying hold and paying the $40 reinstatement fee. There is no restricted driving privilege during the suspension period.

The Practical Reality

Courts understand that losing a license creates a genuine hardship, especially for drivers who need to commute to work in areas without public transit — which is most of Kentucky. But understanding does not translate to legal exceptions. The law does not provide a work-only driving privilege outside of the two restricted license categories above.

The fastest way to drive legally again is to clear the underlying suspension. For unpaid tickets, this can sometimes be resolved in a single visit to the county court clerk. For DUI suspensions, the ignition interlock license application can be submitted before the full suspension period has elapsed.
