Court Debt Is One of the Most Common Suspension Triggers

Unpaid fines and court costs account for a large share of license suspensions in Kentucky. The cycle is familiar: a traffic citation goes to collections, the court notifies the KYTC, the license gets suspended, and the driver — now unable to drive legally to work — falls further behind on the debt.

Kentucky law does provide options for drivers who genuinely cannot afford to pay. Understanding these options before you walk into a courthouse can save significant money and time.

Option 1: Installment Payment Plans

Most Kentucky district courts will consider an installment payment plan for outstanding fines and court costs. There is no uniform statewide policy — each judge and court clerk has discretion over whether to offer plans and what the terms look like.

To request a plan, contact the county court clerk where the citation was issued and ask to schedule a hearing or submit a written request for a payment arrangement. If approved, making the initial payment may allow the court to transmit a clearance to the KYTC, lifting the license hold while you continue making payments.

Ask specifically whether the clearance will be issued upon entering the payment plan or only after completing it. This varies by court and affects how quickly you can drive legally again.

Option 2: The Indigency Waiver (Form AOC-495.8)

Kentucky courts have the authority to reduce or waive court costs for indigent defendants. Form AOC-495.8 (Affidavit of Indigency) is the standard filing used to request this relief.

The affidavit requires you to disclose your income, assets, and financial obligations. The court uses this information to determine whether you qualify for a partial or full waiver. This is not a guaranteed outcome — the judge has discretion — but filing the affidavit is a recognized step in the process and one that many suspended drivers do not know about.

Key points about the indigency waiver:

• File it with the court clerk in the county where the citation was issued
• Be prepared to provide documentation of your income (pay stubs, tax returns, benefit statements)
• A granted waiver can result in the court sending a clearance to the KYTC, lifting the license hold

Restitution Holds Under KRS 532.356

A separate category of court debt involves theft-related restitution. Under KRS 532.356, courts can order drivers convicted of theft-related offenses to pay restitution, and non-payment can result in license suspension.

The clearance process for restitution holds is more specific than for ordinary court debt:

1. Pay the full restitution amount ordered by the court
2. Present proof of payment to the sentencing court
3. The judge signs Form AOC-493.3 (Order of Restitution Repayment Eligibility)
4. Present the signed AOC-493.3 to the KYTC Division of Driver Licensing
5. Pay the $40 KYTC reinstatement fee

For restitution holds, you must pay the full restitution amount, show proof to the sentencing court, and obtain the signed AOC-493.3 before reinstatement can be processed.

After the Court Debt Is Cleared

Resolving the court debt is only the first half. After the court transmits a clearance to the KYTC, you still need to:

1. Verify the electronic clearance reached the KYTC (request a physical court clearance letter as backup)
2. Check your DHR for any other active holds that need separate clearance
3. Pay the $40 administrative reinstatement fee to the KYTC
4. Complete any required testing if your suspension exceeded 365 days
