Vermont Child Support License Suspension: OCS Holds, the 15-Day Notice, and Reinstatement

If you've fallen behind on child support in Vermont, your driver's license is one of the enforcement tools the state can use. The Office of Child Support (OCS) under the Department for Children and Families can pursue a child-support license suspension through administrative or judicial channels when payments are late — and the trigger threshold is lower than most people expect.

When OCS Can Suspend Your License

Under 15 V.S.A. § 798, OCS can suspend your driver's license when child support payments are at least one month overdue or when your arrears exceed one-quarter of your annual obligation. Either trigger is enough.

The process starts with a formal 15-day pre-suspension warning notice. This is your window to act. Once those 15 days pass without compliance, the suspension takes effect — and this child-support suspension stays active indefinitely until resolved. There's no automatic expiration.

The 15-Day Window

That 15-day notice isn't just a heads-up — it's a statutory deadline. During those 15 days, you can:

• Pay the past-due support in full — This immediately resolves the trigger condition.
• Contact OCS and negotiate a repayment plan — Call the OCS regional office or customer service at 800-786-3214. If you can establish an approved monthly repayment agreement before the 15 days expire, the suspension doesn't take effect.
• Contest the pending suspension — The 15-day period is your window to contest it, including a mistaken-identity issue. This is not a general appeals process.

If day 16 arrives and you haven't taken any of these steps, the suspension activates.

Getting Reinstated After a Child Support Suspension

Once the suspension is active, the reinstatement path is:

1. Pay the past-due support in full or sign an approved repayment plan with OCS. The plan needs to be formally agreed to — a verbal promise to pay doesn't count.

2. Wait for OCS to notify the DMV. Under the statute, OCS has a mandatory five-business-day window to transmit the clearance order to the DMV after you've reached compliance.

3. Wait for the DMV to process the clearance. The DMV is bound by a corresponding five-business-day rule to reactivate your license status once they receive OCS's notice.

4. Pay the $80 reinstatement fee to the DMV. This is the standard reinstatement fee for any suspension cause. Pay through myDMV online, by mail, or in person at the Montpelier office.

5. Receive the written Notice of Reinstatement. This is the document that makes your driving legal again. Do not drive before it arrives — criminal DLS charges apply regardless of whether OCS has cleared you.

The Compounding Problem

Child support suspensions create a particularly painful cycle. You need to drive to get to work. You need to work to pay child support. If you lose your license, your ability to earn drops — which makes the arrears grow faster, which keeps the suspension active longer.

Vermont does not offer a hardship or work license for child support suspensions. The only restricted driving credential (the Ignition Interlock RDL) applies exclusively to alcohol-related holds. So the only path is forward: get the repayment plan signed, wait for the clearance chain, and get reinstated.

Timeline to Expect

Best case, if you call OCS on day one and sign a repayment plan quickly:

• OCS clearance to DMV: up to 5 business days
• DMV processing: up to 5 business days
• Reinstatement fee payment and written notice: allow additional DMV processing time after clearance

The two statutory clearance windows alone total up to 10 business days, followed by the time needed to process any fee and issue the written notice. Delays at any step extend the timeline.
