How Child Support Arrears Trigger a License Suspension

In Idaho, Child Support Services (CSS) — a division of the Department of Health and Welfare (DHW) — has the authority to suspend your driver's license, professional licenses, and recreational licenses if you fall behind on child support payments. This is an administrative action, not a court order, and it operates independently from any criminal contempt proceedings.

The suspension is triggered when your unpaid balance reaches either of these thresholds (whichever is lower):

• 90 days of delinquent support payments, OR
• $2,000 in total arrears

Once you hit either threshold, CSS issues a formal Notice of Intent to Suspend. This notice starts a 60-day clock — your window to fix the situation before your license is actually suspended.

The 60-Day Cure Period

After receiving the Notice of Intent, you have 60 days to take one of these actions. If you request an administrative hearing, your written request must be received within 21 calendar days of receiving the notice:

• Pay the arrears in full and bring your account current
• Enter into an approved repayment agreement with CSS that covers both the current support obligation and a plan to pay down the arrears
• Comply with any outstanding subpoenas related to paternity or support proceedings
• Request an administrative hearing in writing to contest the suspension

If you take none of these actions within 60 days, CSS refers the case to ITD Driver Services, which executes the suspension. At that point, your license status changes to "suspended" in the ITD database, and you cannot legally drive unless you later obtain a valid court-issued restricted license or other authorization.

How to Get Your License Back

There are two paths to restore your license after a child support suspension:

Path 1: Pay arrears in full. If you can pay the full outstanding balance, CSS issues a release to ITD. You then submit a reinstatement application (Form ITD 3786) with the $100 reinstatement fee to Driver Services.

Path 2: Sign a repayment agreement. If you can't pay in full, you can negotiate a repayment plan with CSS. Under Idaho Code § 7-1413, signing an approved repayment agreement stays (pauses) the suspension for 180 days. During that stay:

• You must maintain full compliance with your current monthly support obligation
• You must make every payment on the arrears repayment schedule

If you remain compliant through the entire 180-day stay, the suspension is vacated. CSS issues a release, and you submit the reinstatement application with the $100 fee.

If you fall behind on either the current obligation or the repayment plan during the 180-day window, the stay is lifted and the full suspension reactivates.

Can You Get a Restricted License?

Under House Bill 96, a parent whose license is suspended for child support arrears can petition the court for a temporary restricted license to maintain or secure employment. This is a judicial path — you petition the magistrate court, not ITD.

The court weighs whether driving is necessary for your employment and whether restricting your license entirely makes it harder for you to pay the support you owe. If the petition is granted, the court specifies the hours, routes, and purposes you're allowed to drive.

This restricted license is temporary. It doesn't replace the reinstatement process — you still need to resolve the underlying arrears with CSS and pay the $100 reinstatement fee to get your full license back.

The Reinstatement Process Step by Step

1. Contact CSS at your local DHW office to determine your exact arrears balance
2. Pay in full or negotiate a repayment agreement — CSS can set up a formal plan that triggers the 180-day stay
3. Wait for CSS to issue a clearance release to ITD — this is an electronic notification between agencies, not a document you carry
4. Confirm the release posted by checking your license status on the ITD online portal
5. Submit reinstatement application (Form ITD 3786) and the $100 reinstatement fee to Driver Services
6. Verify "Valid" status before driving
7. Visit a county licensing office to get your physical license reissued
