The Law Is Changing: What HB 791 Means for Idaho Drivers

Idaho's rules on license suspensions for unpaid traffic tickets have shifted dramatically over the past decade, and another major change is coming in 2027.

2018 reform (HB 599): Idaho prohibited suspending driver's licenses solely for unpaid infraction penalties. Thousands of drivers who had lost their licenses over unpaid traffic tickets got their driving privileges restored.

2026-2027 reversal (HB 791): House Bill 791 reverses that protection for moving traffic infractions. Starting January 1, 2027, your driver's license, permit, and driving privileges will be suspended if you're 30 days or more delinquent on a penalty for a moving traffic infraction. Pedestrian, bicycle, and parking violations are excluded — but speeding tickets, running stop signs, improper lane changes, and similar moving violations all count.

The implementation timeline: courts begin certifying and transmitting delinquent infraction data to ITD starting July 1, 2026. Mandatory suspensions under HB 791 begin January 1, 2027.

This is a ministerial action — ITD suspends the license automatically upon receiving notice from the court. There's no administrative hearing to challenge the suspension, but the statute provides an expedited appeal to the district court. You can resolve the hold by paying the debt or establishing an approved deferred payment plan.

Failure to Appear: A Separate (and Existing) Problem

You don't need to wait for HB 791 to lose your license over court debt. Failure to appear (FTA) on a traffic citation already triggers a license suspension under current law.

When you miss a court date for a traffic charge — even a minor infraction — the court enters a default judgment and notifies ITD. Your license is suspended until you resolve the underlying case. An FTA on a misdemeanor charge can also result in a bench warrant for your arrest.

The combination is common and painful: you get a speeding ticket, forget about the court date, miss it, your license gets suspended, and you don't find out until a traffic stop. Now you're facing the original ticket, an FTA hold, and potentially a DWP (Driving Without Privileges) charge on top of everything.

How to Clear a Court Debt or FTA Hold

Step 1: Identify every outstanding obligation. Pull your driving record from the ITD online portal and check for court-related holds. If you have tickets in multiple counties, each one must be resolved separately with that county's court clerk.

Step 2: Pay the fines. You have several options:

• Online through the iCourt portal at courtpay.idaho.gov — covers most Idaho courts
• By phone at 1-888-462-1148 (automated payment system)
• In person at the county court clerk's window

If you can't pay in full, contact the court clerk and ask about a deferred payment plan. Courts have the authority to establish installment plans based on your financial situation.

Step 3: Get a clearance receipt. Once payment is complete (or a payment plan is approved), the court clerk issues a stamped clearance receipt. This is the document that tells ITD to lift the hold.

Step 4: Pay the ITD reinstatement fee. For a standard infraction hold, the fee is $25. If the hold involved a traffic-related misdemeanor or a criminal failure to appear, it's $85 ($25 base plus a $60 surcharge). Submit this with your reinstatement application (Form ITD 3786).

Step 5: Verify your status. Check the ITD online portal to confirm your license status shows "Valid" before you drive.

Court debt creates a vicious cycle: you can't drive, so you can't work, so you can't pay the fines.
