Missing a Court Date Triggers Two Separate Problems

When you fail to appear for a scheduled criminal hearing or traffic citation in Massachusetts, the court does two things simultaneously. First, it issues a default warrant for your arrest under G.L. c. 276 § 30. Second, it sends an electronic notification to the RMV, which places an indefinite administrative suspension on your license under G.L. c. 90 § 22(h).

These are independent actions. Resolving the warrant doesn't automatically lift the RMV suspension, and paying the RMV reinstatement fee doesn't clear the warrant. You have to deal with both agencies, in the right order, or you'll waste time and money on steps that don't actually restore your driving privileges.

The 30-Day Warning Window

The RMV typically mails a suspension notice giving you 30 days to resolve the court default before the license suspension takes effect. This window is your best opportunity to act — once the suspension is active, you're subject to criminal penalties for driving, and clearing the hold requires resolving the matter with the court plus presenting the clearance to the RMV.

Step-by-Step: Clearing a Default Warrant Suspension

Step 1: Identify the issuing court. Pull your driving record to find which court triggered each default. If you have multiple defaults from different courts, each one created its own independent suspension — and each requires its own resolution.

Step 2: Resolve the default with the issuing court. Contact the clerk's office at the court that issued the warrant. The court may require an in-person appearance, or may permit a remote hearing or another process. Call ahead to confirm the procedure for that specific courthouse.

Step 3: Pay the default recall fee. Massachusetts courts charge a $50 warrant recall fee per default event under G.L. c. 276 § 30. If you were also facing an underlying fine (for the original traffic citation or criminal charge), that amount is due separately.

Step 4: Obtain the physical clearance document. When the court removes your default, they'll issue one of two documents: a green court release form or a supplemental court abstract. Keep this document in case the electronic clearance does not reach or update the RMV's database.

Step 5: Bring the clearance to the RMV. Present the green release form or supplemental abstract to an RMV Service Center. The staff will manually update your record to remove the court default hold.

Step 6: Pay the RMV reinstatement fee. The RMV charges $100 per court default suspension event, plus a $10 court default removal fee. These are separate from what you paid the court.

Multiple Defaults Multiply Everything

If you have defaults from three different courts, you need three separate court resolutions, three sets of clearance documents, and three reinstatement payments at the RMV. The fees add up: $50 per court recall fee (×3 = $150) plus $110 per RMV reinstatement (×3 = $330), totaling $480 in administrative fees alone before the underlying fines.

The sequencing matters. Clear every court default before paying any RMV reinstatement fees. If you pay to clear one hold but a second court default is still active, your license remains suspended and you've spent money without changing your status.

The Arrest Risk Is Real

An active default warrant means any routine traffic stop or police interaction can expose the warrant and lead to arrest. Massachusetts police have access to the warrant management system, and a default warrant — even one issued over a missed traffic citation hearing — authorizes them to take you into custody.
